Fraud and forgery in probate disputes and helpful hints for handling matters in the new Court of Protection

Introduction

Following the success of our 2006 seminar, Veale Wasbrough Lawyers are pleased to be hosting a new event for 2007. We are delighted that Withy King Solicitors of Bath are joining us this year in presenting the event.

Our seminar will focus on two areas - the current hot topic for all probate practitioners, the Mental Capacity Act 2005 whilst our other main focus of the event will be exploring allegations of forgery and fraud in probate disputes.

Seminar synopsis

Our speakers this year are both from the leading Chancery set of 5 Stone Buildings, Lincoln's Inn and experts in their field:

David Rees will be talking about the Mental Capacity Act 2005. In particular, he will be examining the new Lasting Powers of Attorney, which came into force on 1 October 2007 and pointing out the problems inherent in the new regime. David's talk will prove invaluable to those who are likely to be litigating in the new Court of Protection. David was a member of the working party set up to advise on the rules for the new Court and will be able to share with you some helpful pointers to help you navigate through the new system.

Barbara Rich will provide some handy tips for both contentious and non-contentious practitioners alike who might be involved in advising where an Estate is facing allegations of fraud or forgery when trying to admit a will to probate. Barbara was involved in one of the leading cases in this area, Fuller v Strum (2001) about the alleged forgery of a will.

The seminar will be chaired by Michelle Rose who leads Veale Wasbrough's Contentious Trusts and Probate Team and Amanda Noyce, a Partner at Withy King, who also specialises in contentious trusts and probate.

Speaker details

David Rees

David Rees is a barrister at 5 Stone Buildings, Lincoln’s Inn. He has a general chancery practice with a particular emphasis on Court of Protection work and incapacity issues. He is General Editor of Heywood & Massey’s Court of Protection Practice and was a member of the working party set up to advise on the rules for the new Court of Protection.

Barbara Rich

Barbara Rich is a barrister at 5 Stone Buildings, Lincoln’s Inn. She is regularly instructed to act for the Official Solicitor to the Supreme Court in representing patients and children in trusts and estates litigation and frequently appears in the Court of Protection. She is recommended as a leading junior in the Legal 500 and in the traditional Chancery and pensions sections of Chambers 2007, which notes that 'she catches the eye for her non-barristerial manner and ability to put clients at ease'.

Michelle Rose

Michelle is a Partner at Veale Wasbrough and leads the Private Client Team. Michelle is a member of the Association of Contentious Trusts and Probate Specialists and has over 10 years experience dealing with litigation. She works extensively for clients with concerns and disputes arising out of wills, probate and trusts and acts for private clients, executor and trustee companies, charities, local authorities and lending institutions.

Amanda Noyce

Amanda is a Partner at Withy King Solicitors in Bath and was formerly a Partner at Thring Townsend. She is also a member of the Association of Contentious Trusts and Probate Specialists and a member of the Society of Trusts and Estates Practitioners. She has over 15 years experience of litigation and specialises in the areas of contentious work relating to probate and trusts; tax disputes and negligence actions, as well as Court of Protection work.
