The Department of Health is actively promoting Practice Based Commissioning, and at the same time, the change in the Goodwill Rules relating to the Provision of Enhanced or non-core services has meant that outside commercial providers are enthusiastically pushing themselves into the primary healthcare market place.
As an example, we acted for Medical Property Investment Fund on the appropriate legal documentation for 'joint venture' arrangements with GP practices in a number of locations across the UK.
We have also advised on a number of other joint venture structures, using LLPs arising out of the abolition of the goodwill rules in relation to primary care and the deregulation of the business of dentistry.
