Our objective is to help you avoid conflict and legal disputes. Sometimes, however, these are unavoidable and, if so, we will help you find an effective solution.

Disputes often revolve around the payment of money. The risk of non payment for exporters is ever present. We can assist you to manage these risks by helping you to agree appropriate payment mechanisms and advise on credit insurance and other means of managing your exposure.

If despite these measures problems occur then we can advise you how to resolve the problem and represent you in any legal proceedings.  In appropriate cases we can work with our network of overseas lawyers to get the best results locally.

Work experience/case studies:

  • We advised an Italian sportswear manufacturing company on a dispute with its UK commercial agent.  We advised our client on issues of contractual interpretation, conflict of law, the impact of the Agency Regulations, the treatment of pipeline commission and compensation for loss of agency rights.
  • We assisted an English based supplier of Spanish slate products in recovering a substanstial trading debt from a customer in the former East Germany. We advised on formation of contract issues, conflict of law, the impact of the Brussels Convention and a possible counter claim. We achieved a favourable settlement for our client.
  • We acted for a Greek based animal genetics company in pursuing a claim for damages for breach of the Sale of Goods Act against its UK based supplier and Irish based breeder. We negotiated a substantial settlement just prior to the issue of court proceedings.
