PPP/PFI

We advise Central Government departments on the full range of funding, structuring and development issues. We also provide support in relation to partnering agreements and framework and enabling agreements.

We have a thorough understanding of the issues facing Central Government and have experience of effectively managing the interface between the public and private sectors.

We are thoroughly familiar with H.M. Treasury standardisation in PFI contracts - specifically SoPC3 as updated and all appropriate Treasury, OGC, PUK and other guidance.

Having acted for the MOD on several PPP/PFI projects, we are also extremely familiar with the MOD's standard project agreement (MOD PA). We were one of the MOD's legal panel advisors to participate in the formal consultation on the structure and content of MOD PA.

Work experience/case studies:

  • Advising on a PFI redevelopment project incorporating innovative office space, accommodation and leisure services and involving the rationalisation of the Defence Communications Services Agency's HQ and existing estate including its network of underground tunnels. Our work has included drafting the project agreement, reviewing bidder responses and advising the MOD accordingly, advising on the evaluation and scoring of responses and assisting in the drawing up of evaluation matrices.
  • Advising the Naval Recruiting and Training Agency on umbrella arrangements with Flagship Training Limited. Our work included preparing the Head Agreement and Enabling Agreement for the PFI, income generation, service provision and a PFI contract for the provision of fire fighting training services.
  • Acting in relation to a PFI agreement with a contractor for the provision of a UK Vehicle Fleet service, the value of the contract being in the order of £500 million and involving external capital investment from a syndicate of banks.
