Our Projects team provides specialist advice on the complete range of issues involved with partnerships/strategic partnerships. We advise on the delivery of the proposed partnership arrangements, including whether your objectives are best met through a corporate vehicle, contractual joint venture, a contract with partnering arrangements or a non-contractually binding ‘partnering’ pledge.

The process of choosing the type of arrangement to use is largely one of identifying and matching relevant objectives, the commercial reality to achieve the objectives and the balancing of risk. In each arrangement there will also be different consequences in terms of the issues which the governance arrangements will need to address.

Work experience/case studies:

  • Advising the Met Office on its partnering arrangements with the Engineering and Physical Sciences Research Council and the Natural Environment Research Council in connection with the development and procurement of high performance computer projects. This has involved drafting a bespoke partnering agreement which establishes the objectives and governance of a joint approach to the future procurement of shared assets and services.
  • For the Fire Service College ("FSC") we have drafted and advised on a Cooperation and Framework Agreement with the Fire Protection Association ("FPA"), the UK national fire safety organisation, to maximise the product convergence and business objective crossover of FSC and FPA. FSC now provides FPA with offices on FSC's site together with accommodation in its state of the art and world-class fire training facilities. The agreement also establishes strategic partnering principles for the development of the relationship between FSC and FPA.
  • Acting for the Naval Recruiting & Training Agency, on the partnering arrangements and PFI Prime Contracting Enabling Agreement signed with Flagship Fire Fighting Training Limited for the provision of fire fighting training services and facilities. We negotiated agreements with Barclays who were involved in the funding of Flagship.
