Objective

  • To contribute to the development of the tax team.
  • Developing the skills to take wider responsibility for advice to colleagues and clients.

Required knowledge and experience

  • Qualified Solicitor with a desire to specialise in business tax.
  • Minimum experience is likely to be one or two training seats in reorganised city or regional firm.
  • Demonstrable enthusiasm for the area of law and commitment to develop the skills to progress to a senior level.

Key tasks 

The work is likely to involve the following; 

  • Advising nurseries and day, boarding and international schools on the operation of their contract for educational services (Parent Contract) and associated documents including third party fee agreements, advance school fees schemes and the provision of consumer credit;
  • Advising nurseries and schools on the full range of matters affecting the provision of educational services, including but not limited to admissions and exclusions, behaviour and discipline, drugs and substances, data protection, fees and notice, parental responsibility, guardianship;
  • Advising nurseries and schools on registration and compliance with statutory inspection requirements;
  • Advising nurseries and schools on procedures with Human Rights elements, including complaints handling and the convening of governor review panels;
  • Advising nurseries and schools on Child Protection matters, including allegations of abuse;
  • Advising nurseries and schools on Special Educational Needs and Disability Discrimination, including defending claims brought in the Special Educational Needs and Disability Tribunal (SENDIST);
  • Developing new policies and procedures in response to changes in sector practice and the law.

Required skills

The ability to:

  • advocate and present orally when required
  • conduct effective case and transaction management
  • develop strong client relationships
  • communicate concisely both verbally and in writing with colleagues and clients
  • draft documents that are clear and concise
  • interview and advise clients, helping them decide the best course of action
  • research the relevant legal issues applicable to a case

Objective

To work with colleagues to help clients succeed in realising their business or personal objectives, through the efficient delivery of appropriate legal advice and assistance in support of the following plans: Education Sector; Pastoral Sub-Sector; Nurseries Sub-Sector; Healthcare Sector and, Health & Social Care Sub-Sector.

Required knowledge and experience

The majority of work is likely to be commercial by nature; ie: advising on parent contracts and policies. Experience of education, child and care law would be very desirable but is not essential, as would experience of advising operators in the education sector. 

The team also undertakes "incident management" work for education providers and although the applicant would not be expected to be involved in such work initially, there would be scope to assist with such work. 

The work is to be in support of various sector plans, in particular the Education Sector Plan and the Pastoral Sub-Sector Plan. There may be scope to support other plans such as the Nurseries and Health & Social Care Sub-Sector Plans. 

The role may be suited to a commercial lawyer who is looking for a change of direction and the ability to try something a little bit different. 

Admitted solicitor or barrister with current Practising Certificate and a developing expertise in education, child or care law. Must demonstrate an ability to work to the SRA Skills Standards and to provide accurate, focused advice to clients.
